Common Types of Custody Arrangements in Collin County

Parents - and judges, if the court is making a decision - have more options than ever before when it comes to making a plan for co-parenting after divorce. The default arrangement used to be primary custody for the mother and visitation for the father. However, those days are gone. Common types of child custody arrangements in Texas include:

  • 50/50 custody - The child may split their time evenly between each parent's household. The child may spend a week with one parent, and then a week with the other, or other schedules may be created in which a child spends time with each parent on different days of the week. This type of arrangement typically works best when the parents live near each other, and both work normal daytime hours.
  • Primary custody and visitation - If the parents live far apart so that moving the child back and forth is logistically difficult, it is likely that the child will spend most of their time with one parent and stay with the other during school breaks. This arrangement may also work best if one parent is frequently out of town for work or works nights.
  • Supervised visitation only - When one parent may not be able to safely care for the child on their own but is not so harmful that the court wants to keep them away from the child entirely, the court may order supervised visitation. This form of visitation can take place in the community with an appointed adult present or in a designated visitation center. This arrangement is common when one parent has a serious mental illness, a substance abuse problem they are working on, or certain recent criminal convictions.
  • Flexible custody plans for military members - In some cases, such as when one parent is on active military duty, a plan may require some flexibility. One parent may have custody while the other is deployed for long periods of time, and then the children may spend months with the military parent upon their return. Flexibility may also need to be arranged if one parent has an irregular work schedule.
  • Sole custody - Sole custody is very rare, and it is generally granted only in cases where it has been proven that one parent poses a substantial risk of physical or emotional harm to the child. For example, if one parent has been convicted of child abuse or child endangerment, the other parent may be granted sole custody.
